House Bill 77 Legislation passed in July 2021 and made effective January 1, 2022. The new law, provides that the current Jury Division be renamed DIVISION A. The name Jury Division will not be used on and forward of January 1, 2022, and shall be referred to as DIVISION A of the DeKalb County State Court. consists of the Civil and Criminal Departments of the State Court.
State Court Division B was established following the dissolution of the Recorder’s Court of DeKalb County, effective July 1, 2015. As part of this transition, all traffic case records were transferred to the Clerk of the State Court of DeKalb County. All other records, including those related to code enforcement cases, were transferred to the Clerk of the Magistrate Court of DeKalb County. The Marshal’s Office, as part of DeKalb County’s law enforcement community, is committed to protect life and property, arrest violators of the law, and enforce all laws and ordinances coming within the Office’s jurisdiction.
The mission of the DUI Cout Program is to enhance public safety by reducing recidivism of DUI offenders by breaking the cycle of addiction through a combination of individualized treatment, personal accountability, and intensive court supervision to promote individual responsibility and citizenship and return a more productive member back to the community.
The Court Administrator’s Office provides essential administrative and operational support to the judges of the State Court. Its core responsibilities include: Judicial Support Services – Coordinating daily court operations to ensure the efficient administration of justice.
Budget Management – Developing and overseeing the court’s budget in collaboration with county financial authorities.
Facilities Maintenance Coordination – Serving as the liaison for courtroom and judicial facility maintenance and improvements.
Interpreter Services – Managing interpreter requests to ensure language access for all court participants.
Interagency Liaison – Facilitating communication and coordination between the judiciary and other government agencies.

The DeKalb County State Court Probation Department was created and legislated by the governing authority September 16, 1992 through HB 1607, . We are a full-service law enforcement agency, made up of administrative staff and POST certified, sworn officers who protect and serve the community.  The Probation Dept. is an integral part of the criminal justice system and law enforcement community of DeKalb County, Ga.
The DeKalb County Magistrate Court—often called “the people’s court”—is a vital part of Georgia’s judicial system, handling a wide range of civil, criminal, and ordinance matters for DeKalb County residents.

Inclement Weather Announcement

Given the statewide State of Emergency and in accordance with the Judicial Emergency Order issued by DeKalb County Chief Superior Court Judge, Shondeana C. Morris, all courthouse divisions of DeKalb County State Court will be closed from Sunday, January 25, 2026, beginning at 8:00 am until Tuesday, January 27, 2026, at 8:00 am when the Court will resume normal proceedings.

How can I check to see if I have a bench warrant?

You must go to the DeKalb County Jail with a State issued ID to inquire about an active warrant.

How do I change my court date?

You must e-file your request. The pleading will be forwarded to the judicial case manager.

How do I get a copy of the transcript in my case?

You can request a copy of the transcript with the Judge’s staff. Fees may apply.

How do I collect my judgment?

● Obtain a Writ of Fieri Facias (Fi Fa) to record a lien or seize assets.
● Levy on property (see levy process).
● Garnish bank accounts or wages (see garnishment process).

How do I file a Motion for a misdemeanor case?

You must compose your own motions and file them with the clerk’s office or via e-file. Resources: Law Library (4th floor), attorneys, Legal Aid, or DeKalb Volunteer Lawyers Foundation.

How do I update my address?

How do I change my court date?

How do I appeal a sentence?

File a Notice of Appeal and pay $25. Include case number and specify whether you are appealing to the Georgia Court of Appeals or the Supreme Court of Georgia.

How do I put out a warrant on someone?

How long does it take for my case to be accused?

The solicitor’s office accuses cases within two years of the arrest or citation. Therefore, the Clerk’s Office does not know when an accusation will be filed. Please contact the Solicitor’s Office (404) 371-2201
